"New criminal offense, kidnapping of minors" "DENISE LAW" renamed 'Denise', in honor of Denise Pipitone

"Presentation of New criminal offense, kidnapping of minors" - Tomorrow, Monday, November 23, at the press room of Palazzo Montecitorio in Rome, the law that came into force with the security package last July will be presented, introducing two new articles to the penal code. Art. 574 Bis abduction of a minor taken abroad and Art. 605 paragraph 3 which introduced the new criminal offense of kidnapping a minor. Tomorrow they will be presented to the press in the presence of Piera Maggio and Hon. Barbara Mannucci, of the PDL, the first signatory of the amendment to the security package. The novelty of the crime of kidnapping a minor is that, in addition to protecting individual freedom, it also protects the right to parental authority. The penalties provided are up to 15 years in prison and life imprisonment in case of death of the kidnapped minor. The presentation takes place the day before the start of the trial against Jessica Pulizzi for the kidnapping of Minor Denise, which will open in Marsala on Tuesday 24, where the Preliminary Hearing will be held.
Piera Maggio will join as a civil party, requesting the highest compensation for damages in the history of Italian trials.

Law 94/2009 came into force on August 14, 2009 with which two new types of crime were introduced into the penal code. Lawyer Giacomo Frazzitta was the drafter, and Ms. Piera Maggio supported the legislative process.

The process of proposing the amendment to the penal code began in 2006 following the kidnapping of the minor Denise Pipitone.
Ms. Piera Maggio, mother of Denise Pipitone, and legal representative of the association "Cerchiamo Denise" Onlus, tenaciously supported the legislative process, chained herself and went on a hunger strike in front of the Quirinale on 10/26/2007, the day of Denise's seventh birthday, to obtain the approval of the renamed "DENISE LAW", obtaining in August 2009 the launch of the amendment to the penal code, as part of the so-called Security Package that the Berlusconi Government issued that year.

After the request to create an international task force for the search for missing children, launched on September 1, 2010, Piera Maggio, the mother of Denise Pipitone, the little girl who disappeared in Mazara del Vallo (Sicily-Italy) on September 1, 2004, will be a guest in the morning at the Royal Palace of Brussels, at the conference "Vulnerable Children on the run, a European Challenge" and in the early afternoon will speak at the press room of the European Parliament at the conference "European strategies against the phenomenon of missing children", together with the honorable vice presidents of the European Parliament Angelilli, Pittella, McMillan-Scott and Hon. The Vice President of the European Parliament, Roberta Angelilli, met on November 17 in Brussels with Piera Maggio, the mother of little Denise Pipitone who disappeared six years ago in Mazara del Vallo.

The officials of the European Commission who deal with missing children have given their full support to Denise's mother's project, who proposed to launch an international task force capable of acting promptly in the event of a child's disappearance. In addition, the establishment of a single European operational unit for the search for children through the media has been requested, as well as widespread and permanent dissemination of the child's images via SMS, MMS, television, internet... in order to raise awareness among millions of people in a very short time. Open letter to the parents of missing or violated minors

Dear parents,

The person writing to you is a mother who is suffering, just like all of you.

My pain is that of having lost a daughter, taken away by an ignoble hand that trampled on my little girl's rights and took her away from the love of her family." I address you, parents who have suffered the abduction of a minor child or who have endured the tragedy of disappearance followed by the murder of your little one. Only those who have suffered and continue to suffer the same dramatic pain that, for seven years, has not allowed me to live, can understand that mine is a cry of true suffering.

I have always tried to fight to bring my daughter home, and to find out the truth about what happened to her. You, like me, have suffered the greatest wrong a person can endure: seeing your children violated for no reason. A blind and perverse evil struck them, and a thousand times we would have wished it struck us instead of our children... but today we are the ones left here, having survived them or desperately searching for them. I would like to ask all of you to give meaning to the injustice you have suffered by helping me to establish a committee for the promotion of an international task force for the search for missing children. I have worked hard together with my collaborators to try to create new horizons and never abandon hope, so today I ask you to be united and to overcome the resistance that a single parent encounters in their desperate attempt to change things. Consider, if you will, the evil that has struck us as a very rare disease: if we do not unite, we will remain isolated cases, drops in the ocean, and lost in our pain.

Instead, by joining forces we can do a lot, and this is what I ask of you. Get in touch with me, I look forward to your reply with confidence.

What is the international task force for missing children searches?

It is a new idea of intelligence specifically aimed at cases of missing minors. It is an operational group made up of people skilled in different fields and professions, capable of creating and implementing initiatives for the search for missing minors. It is international as it works beyond the competences and limits of a single state.

Is it composed of police forces from different countries?

No, on the contrary, these are professionals from different fields who are able to carry out research plans outside or in a complementary way to the police forces.

What would be the headquarters of this organization?

The city of Brussels, in Belgium.

Are the parents of missing minors called to be part of this organization?

Generally speaking, no, parents are called upon to promote the development of this body, supervising its functions (one thinks of a guarantor role for the proper functioning of the entity)

Why is it necessary to support this initiative?

Because it is a complex project that at present is not supported by any of the member states of the European Union, but which can be developed with the commitment and collaboration of all those interested and supporters.

Why should this type of organization prove to be better than others in research?

Because it is established exclusively for this purpose, and to improve the organizational approach in cases of missing persons. There are almost no organizations at the European level that make use of the collaboration and support of those directly involved (the parents) in the searches. Qu'est-ce qu'est la task force internationale pour les recherches de plus petits?

C'est une nouvelle idée intelligente spécifiquement dédiée aux cas des mineurs disparus. C'est un groupe opérationnel composé par gens compétents avec des champs et des métiers différents, aptse à créer et réaliser des initiatives pour les recherches des petits disparus. C'est comme un groupe de travail international en dehors des pouvoirs et des limites d'un seul Etat.

Serait-elle composée des forces de police de différents pays?

Non, ce sont au contraire des professionnels dans différents domaines qui sont en mesure de mettre en ouvre des initiatives extérieures ou de façon complémentaire à la police.

En principe non, les parents sont appelés à promouvoir le développement de cet organe, de superviser les fonctions (on pense au rôle de garantie pour le bon fonctionnement de l'institution)

Pourquoi soutenir cette initiative?

Parce que c'est un projet complexe qui n'est pas actuellement pris en charge par l'un des états membres de l'UE, mais qui peut être développés avec l'engagement et la collaboration de tous les acteurs et les supporters.

Est-ce que ce type d'organisation devrait être mieux que d'autres dans la recherche?

Parce qu'il est constitué exclusivement pour cela, et pour améliorer l'approche organisationnelle dans les cas de personnes disparues. Les organisations sont quasi inexistantes au niveau européen avec la collaboration et le soutien des parties intéressées (parents) pour les recherches. La capacité à développer des solutions à des problèmes communs de tous les parents d'enfants disparus estfondamenale afin d'identifier et de proposer des solutions possibles aux Etats européens membres de l'Union.

Press release September 1, 2012, 8 years since Denise's disappearance

PRESS RELEASE -               September 1, 2004 – September 1, 2012 - Eight long years since Denise's disappearance

Eight long years have passed since the despicable act committed against my daughter Denise, and today, as then, I feel that “Justice,” with a capital “J,” is far away. I am referring both to the responsibilities of the judiciary, but also more generally to the commitments and promises of the Italian institutions that should have acted to find my daughter.

In any case, let's proceed step by step, and start with the judicial sphere, because the trial against those accused of kidnapping my daughter is currently underway. As many as 11 magistrates have alternated over these 8 years, and in particular I mention: Prosecutor Sciuto, who was succeeded by the current Prosecutor Di Pisa, and also, in chronological order, the deputies Dr. Boccia, Dr. Angioni, Dr. Puliatti (from the Prosecutor's Office at the Juvenile Court of Palermo), Dr. Avila, Dr. Imperato, Dr. Sessa, Dr. Cerroni, Dr. Brandini, Dr. Carmazzi.

They carry out what I call the "justice of the magistrates," but often this type of work does not satisfy the victims: for example, too many and continuous changes have certainly not benefited the proceedings. The trial for the kidnapping of my daughter Denise has an urgent need for particular attention, especially regarding the historical memory of the judicial and investigative records, given the amount of related information. Yet, as soon as the magistrates became familiar with the 350,000 documents and had begun to untangle the complicated web created by the technical consultant of the Prosecutor's Office, Dr. (now lawyer) Genchi, a transfer would occur. The continuous transfers (sometimes even requested by the magistrates themselves) definitively undermined the possibility of getting to the bottom of the situation. The most recent departure, in chronological order, was that of Dr. Brandini, who moved to the nearby Prosecutor's Office of Termini Imerese.

Well, to this day I have no further news about the investigation reopened in 2010. Through my lawyer, in recent months we have filed a request with the Prosecutor's Office to obtain information about the outcome of the investigation and the decisions the Prosecutor's Office has made.

We have asked to officially know whether the investigation is continuing or whether it is necessary to proceed with a request for indictment or with a request for dismissal regarding the case involving the mother of the current defendant Jessica Pulizzi, that is, Anna Corona.

In the main trial, hearings are sometimes scheduled at a very slow pace.

I wonder if it is normal or right that magistrates can leave such laborious and complex investigations (as well as costly for the state) to be managed in a fragmented way by several people, all without the supervisory bodies of the judiciary or the ministry intervening to carry out the necessary checks…

I wonder if, after a judicial ordeal like the one I am going through, someone will compensate me for the mistakes made and those that continue to be made. Justice without continuity is, in fact, legalized injustice. If doctors make mistakes, they must answer for their errors, just like all other social categories. However, I ask myself: and if the mistake is made by a magistrate, will the latter pay for their mistakes in our country?

During the ongoing trial, as the injured party, we feel "deprived" of our technical consultants, who were not allowed to provide counterarguments. I am referring in particular to Prof. Roberto Cusani, professor of telecommunications at Sapienza University of Rome, who could make an important contribution to clarifying the truth or falsehoods emerging during the proceedings, but who has instead been sidelined.

The Court deemed admissible questions on “dreams and esotericism” rather than on the topics provided as contributions by a luminary in the field of telecommunications.

I hope that this Court can reconsider the absurd position taken during the proceedings in excluding our consultant. In summary, I have no further news about the investigation and the trial has been stagnant since the beginning of the year due to the convoluted report by the former doctor, now lawyer, Genchi.

Not to mention that, as far as I know, no one has investigated the serious statements that Genchi made about a Police Officer who was then head of the Mazara del Vallo Police Station and about the closeness between the latter's wife and Anna Corona, the mother of the accused...

It's all scandalous: both the Prosecutors who transfer and the Police officers who can tamper with the investigations.

If this was the situation in the judicial sphere, my daughter's case fared no better with the institutions. Dozens and dozens of meetings, promises, handshakes; reassurances from politicians, members of parliament, ministers, and delegates... Everyone competed to show their interest in my daughter's case, but unfortunately, very few really decided to "continue" and persist on the matter. For many people, the Denise case was a "hit and run" event, which perhaps represented an opportunity for personal promotion.

I urged the Italian institutions to take responsibility for Denise's case, as well as for all missing children. Appeals to the Church to issue a statement in support of a little girl were useless. Equally useless was the appeal to the former President of the Republic to officially recognize Denise as "the daughter of all Italians." It was a strong message of national solidarity, to be expressed in favor of all missing children, for whom the head of state should be the first moral support.

Some may say that I was received at the Quirinale, but others know that I had to chain myself up to get a little attention... so I wouldn't say I found the door wide open. Our politicians have other things on their minds, and when they are directly involved in the problems of ordinary people, they are definitely annoyed and try to dismiss the situation as quickly as possible and at the lowest possible "cost" (I'm not referring at all to the financial help that has never been seen, but to the personal and moral support).

I fought for the approval of a legal amendment to severely punish those responsible for the abduction of minors. Thanks to the involvement of a few wise politicians, the regulation has made a small step forward: but how much effort it took to move in the right direction, how much hard work for a result whose usefulness was obvious to everyone!

Hundreds of appeals on television and dedicated sector broadcasts, with constant effort applied to initiatives for spreading my daughter's image, have brought the case to the attention of international media and I had the opportunity to be a guest at the European Parliament, where, before the committee dealing with minors, I was able to express a serious opinion about the methods of intervention and alert in the early stages of children's "disappearances." Only, nothing I proposed was actually taken up. If a child is kidnapped today, exactly what always happened in the past happens; in eight years there has been no improvement in the effectiveness of the institutions' response in the early stages of a child's abduction. The only thing that may have changed is the response of ordinary people, who perhaps after so many battles and so much commitment, have understood that a mother's voice must not go unheard, because horrible things can happen to anyone, in Sicily and in Lombardy, and they are not limited to those cases where it is said "it's within the family." It is always "within the family," only that many families are affected and people have begun to understand that you cannot sleep soundly when you are a parent and without institutions to protect you. I ask for everyone's help. Do not abandon Denise to a fate she did not choose to have. Help me regain trust, because today I no longer know who the good people are and who the bad ones are.
