The preliminary hearing on the kidnapping of Denise Pipitone, the girl abducted five years ago in Mazara del Vallo, was held today at the Marsala Court. The only suspects are Jessica Pulizzi, Denise's half-sister, and her ex-boyfriend, Gaspare Ghaleb, who, however, is only charged with making false statements to the prosecutor.
The mother of the little girl, Piera Maggio, before the hearing began said: "Beyond any sentence or fact expressed in court, I morally condemn the suspect Jessica Pulizzi and her mother Anna Corona, for not cooperating with the investigating authorities." She then emphasized that "in the case of innocent people, as the suspects claim to be, it is not appropriate for them to exercise the right to remain silent." "I cannot accept," added Denise's mother, who disappeared on September 1, 2004, "that these two women for five years deliberately decided not to cooperate with justice, thus failing to clarify the entire affair. Only monsters could have harmed their own innocent little sister who didn't even know them."
Once the hearing began, Judge Lucia Fontana rejected the request made by Jessica Pulizzi's lawyer, Gioacchino Sbacchi, submitted last November 24 regarding the jurisdiction to try the defendant, 22 years old. According to the girl's defense attorney, the Juvenile Court of Palermo should have jurisdiction, because at the time of the kidnapping the defendant was not yet eighteen. Judge Lucia Fontana decided that jurisdiction over Denise's disappearance belongs to the ordinary court and not the juvenile court.
The crime Jessica Pulizzi is charged with is complicity in kidnapping, with the aggravating circumstance that the victim is under 14 years old. This offense was introduced with the security package enacted by the government, strongly advocated by Piera Maggio and her lawyer, attorney Giacomo Frazzitta, and provides for a sentence of up to 15 years in prison.
"We respect the judge's decisions even if we do not agree with them. This naturally does not mean that Jessica is guilty," said lawyer Gioacchino Sbacchi. When asked if he would request alternative procedures, lawyer Sbacchi replied: "The law gives us a deadline to decide and we will take all the time allowed."
The judge for preliminary hearings in Marsala also accepted the request for civil party status submitted by Piera Maggio and Tony Pipitone, Denise's parents. The request was also granted for the child's biological father, Piero Pulizzi, who is also Jessica's parent.
Lucia Fontana has finally postponed the hearing to next January 8, when the closing arguments by prosecutor Laura Cerroni and the statements of the civil parties are scheduled. During a subsequent hearing, set for January 11, the Gup will decide whether to indict the defendants or to dismiss the case.
"I am very shaken, even though the hearing went well. My state of mind is that of a mother who is about to spend her fifth Christmas in a row without her little girl." These were the words of Piera Maggio as she left the courtroom. Denise's mother once again highlighted the absence of the two defendants at the hearing: "It is abominable not to want to cooperate, always making use of the right to remain silent, in the case of a missing child. Beyond any sentence or fact expressed in court, I morally condemn the suspect Jessica Pulizzi and her mother Anna Corona, for not having cooperated with the investigating authorities. In fact, since mid-March 2005, both of them have exercised their right to remain silent. But to better understand the gravity of the situation, imagine for a moment that your little girl, your daughter, is in grave danger, and someone close to her is the only one able to save her, with a small gesture. What would you think if your daughter died because that person, that individual, did not want to help her because they were "afraid" of hurting their finger? Surely you would think that this is a despicable person who has committed a vile and shameful act. This is the comparison I want to make clear: if someone knows they are guilty, it is plausible that they would exercise their right to remain silent so as not to worsen their own position, as it is a constitutionally guaranteed right. In my case, however, I have seen people who claim to be unrelated to the facts and who still exercise the right to remain silent, saying they are not guilty. So what is this act if not an inhuman lack of help towards a little girl? If you can imagine this, you will understand why I morally condemn Jessica Pulizzi and her mother Anna Corona; mind you, I use the term "morally" because criminal condemnation is up to the judiciary. I cannot accept that these two women for 5 years deliberately decided not to cooperate with justice, thus failing to clarify the whole affair. Furthermore, for all those who believe that the facts can be limited only to a certain family unit, I emphasize that Denise had no relationship with her father's previous family. I add that she is not a child different from many others in our country and in the world, as the daughter of a father who had other children from a previous marriage. But in no other case, not even those involving organized crime, has a girl ever been accused of such an atrocious crime: only monsters could have harmed their own innocent little sister who didn't even know them!

Piero Pulizzi confirms that he will join as a civil party
Mazara del Vallo (TP), 25-11-2009 - "I confirm that I will join the trial as a civil party and I deny anyone who claims the opposite," said Denise's biological father, Piero Pulizzi, regarding the ongoing trial in which his other daughter, Jessica, is accused of kidnapping the minor. The denial became necessary since some news reports and newspapers spread the news that he would give up this possibility, obviously creating confusion. He continues: "It will be up to the judge to decide on my request to be admitted as a civil party in the trial, which was submitted by my lawyer in my presence during the preliminary hearing held on November 24, a hearing that was postponed to next December 18. I want justice and truth; whoever committed the act must pay for the harm caused to Denise."

Denise, the trial begins with a postponement
November 24, 2009 - The establishment of civil parties in the trial for the kidnapping of little Denise Pipitone was not even addressed at today's preliminary hearing. Judge Lucia Fontana has in fact postponed everything to the hearing on December 18, to first decide on the motion presented by lawyer Gioacchino Sbacchi, defender of the accused Jessica Pulizzi, the child's stepsister, who argued that the juvenile court had jurisdiction since the girl was still a minor at the time of the events. The girl is accused of kidnapping together with her ex-boyfriend, Gaspare Ghaleb.
A decision that was not shared by lawyer Giacomo Frazzitta, legal representative of the Pipitone family, according to whom the judge could have meanwhile ruled on the requests for civil party status made both by Denise's parents, Piera Maggio and Tony Pipitone, and by the child's biological father, Piero Pulizzi, who is also Jessica's father.
"This postponement is inadmissible, given that we have been waiting for justice for five years. I did not agree and I also stated so in court," emphasized lawyer Giacomo Frazzitta. "We were ready to respond," he explained, "even regarding the defense's request and we presented this to the judge, but she preferred to postpone everything. In short, we are faced with a stalemate."
Regarding the objection raised by Jessica Pulizzi's defense attorney, the Pipitone family's lawyer objects: "Lawyer Sbacchi is certainly a colleague with a recognized reputation, but he cited a particularly outdated doctrine, while established case law states that jurisdiction, in the event that the crime of kidnapping is committed by a minor and continues after reaching adulthood, belongs to the ordinary court." Regarding Jessica Pulizzi's letter, where the young woman speaks of a media assault against her, lawyer Frazzitta observes: "She says she is suffering a media assault, but she is accused of an assault against a child. She could have appeared in court to defend herself and did not do so. This is a poor defense strategy." Source
DENISE: DEFENSE INSISTS ON PALERMO JURISDICTION, HEARING POSTPONED (AGI) - Trapani, Nov. 24 - "Jessica Pulizzi's lawyers have raised a question of jurisdiction, arguing that the proceedings should be handled by the Juvenile Court of Palermo, because their client was a minor at the time of Denise's kidnapping." This was stated by lawyer Giacomo Frazzitta, legal counsel for Denise Pipitone's mother, Piera Maggio, at the conclusion of the preliminary hearing held this morning at the Marsala Courthouse. The Gup postponed the decision both on the admission of civil parties and on jurisdiction to December 18. "We have been waiting for justice for five years," said Frazzitta, "and we were ready to speak immediately after the constitution of the civil party." "Unfortunately, five years have not been enough," commented Piera Maggio, "Denise has been waiting too long and unfortunately too much time is passing."
The suspects chose not to be present, but above all Jessica has shown cowardice all these years." Jessica Pulizzi sent a letter to the judge through her lawyers stating that she chose not to be present "as a result of the media assault suffered".
"Jessica apologized for her absence - comments Piera Maggio - but I also experienced media pressure, and if she had spoken, the pressure on her would have been less; all the people involved in the investigation cooperated and making use of the right not to answer, as Jessica Pulizzi did, is a right but it was not helpful to Denise. "New criminal offense, kidnapping of minors"
"Presentation of the New Crime Figure, Kidnapping of Minors" - Tomorrow, Monday, November 23, in the press room of Palazzo Montecitorio in Rome, the law that came into force with last July's security package, which introduced two new articles to the penal code, will be presented. Mazara del Vallo, 26-10-2009. It's Denise's birthday. The girl from Mazara del Vallo turns nine this year, celebrating her fifth birthday away from home. Unforgettable in the minds and hearts of all Italians are the days of the kidnapping and the family's despair. Days of anguish followed by years of struggle to obtain justice: even a law was changed in favor of all cases of kidnapping of minors without the purpose of extortion. Some have even spoken of the "War of Piera," referring to the courage of Denise's mother, who never stopped believing in her daughter's return home. From her words, a message to her daughter: "Today is a special day for you. Nine years ago you came into the world to the joy of all the people who love you. You may not know that today is your birthday, but wherever you are I hope someone brings you greetings from your mom and dad. We will fight to the end to bring you home and to obtain the justice that has been lacking these five years." Piera Maggio indeed complains about the slowness of the criminal proceedings initiated and the poor results obtained so far by the investigating authorities. The coming days could in any case represent a turning point: on November 24 there will be the preliminary hearing for the trial of the current suspects (stepsister Jessica Pulizzi and her ex-boyfriend Gaspare Ghaleb) and the magistrates have not yet ruled on the opposition request, presented by the family's lawyer, against the dismissal of the case for other individuals who could be involved following an expert report on the mobile phone network. Denise's family has expressed thanks to all those who over the years have been morally close to the case, to Denise's friends near and far (there are millions of contacts from all over the world, including Facebook and various blogs). A special thought goes to the Luigi Pirandello school, the principal and the teachers, who have always celebrated the girl's birthday firmly believing in her return. On the occasion of little Denise's birthday, the "L. Pirandello" Comprehensive Institute has organized a simple initiative of solidarity and affection for the child and her family. In particular, a simple walk for Denise is planned with the following schedule: at 9:30 a.m. on Monday the 26th of this month, the students of the third, fourth, and fifth grades of the primary school will join in a procession with the first-year students of the lower secondary school and together they will parade along Via Salemi and Corso Umberto I, until they reach, around 10:30 a.m., Piazza Mokarta, at the municipal park where the tree in memory of Denise is planted.
The primary school students intend to dedicate a thought to their classmate through poems and phrases they have composed.

Preliminary hearing finally set for the two suspects

Mazara Del Vallo 06/10/09 - The preliminary hearing has been set for the two current suspects, Jessica Pulizzi, investigated for complicity in the kidnapping of Denise, and her ex-boyfriend Gaspare Ghaleb, investigated for giving false testimony to the Public Prosecutor. The hearing will be held on November 24. Denise's mother, Piera Maggio, declares: "Finally something is starting to move, too much bureaucracy and slowness, too much time is passing. In the meantime, we are also waiting for the response from Judge Dr. Sergio Gulotta regarding the opposition request that was submitted by my lawyer on July 21, during the discussion held at the Prosecutor's Office. We will see what awaits us."

Denise: now a trace is being sought in cellular communications

Mazara del Vallo, 09/23/2009 - 19:19. New lines of investigation are opening up regarding the disappearance of Denise Pipitone. According to the latest findings, on the night between September 1 and 2, 2004, there was a person from the circle of suspects who allegedly moved from Mazara del Vallo to a city in the Palermo hinterland. This information was confirmed by the trace of their cell phone, which was connected to a radio tower near Palermo. This fact has recently come to light because the phone operator's data was only recently subjected to a specific analysis by Prof. Roberto Cusani, Professor of Telecommunications at the "La Sapienza" University of Rome, who is a leading expert in the field. Among the data that emerged, there is also a recording of the cell phone owner's voice regarding the child at 6:30 in the morning (at that time, in fact, the Public Prosecutor's Office of Marsala had placed many phone lines under surveillance, including the one involved in the nighttime movement). New elements, therefore, to understand the various movements of little Denise during those crucial hours. The expert confirmed the data by calculating the route taken by that cell phone on the night between September 1 and 2. Essentially, the cell phone was turned on at 6:15 in a city near Palermo, at 6:18 in a city in the province of Trapani, and at 6:25 on a radio tower on the outskirts of Trapani. The Prosecutor's consultant considered this anomaly to be catalogued as the "Peter Pan" effect (a phenomenon in which the signal appears to be located in several different places at the same time, ed.), but in reality Prof. Cusani determined that such data would have been generated by an automatic mechanism of the phone operator, because the monitored number had been called by another line, and since it was unreachable, the phone operator activated a search mechanism for the cell phone in the places where the line had passed in order to send the usual SMS notification. These considerations therefore determine that there was no implausibly fast movement of the cell phone between very distant areas, but rather a search for it in the last cells to which it had been connected. Piera Maggio herself commented on this data, saying she is "tired of waiting," since the new evidence was already notified to Judge Dr. Sergio Gulotta on July 21, to be included in the opposition to the request for dismissal, but apparently the magistrate has not yet ruled on whether the investigation will continue. Meanwhile, Denise's family is also awaiting the preliminary hearing for the indictment of Jessica Pulizzi and Gaspare Ghaleb, which the office of the G.U.P. of Marsala has not yet scheduled.

Mazara del Vallo (TP), 01/09/2009. Today marks the fifth anniversary of the kidnapping of Denise Pipitone. Numerous initiatives are underway at this time in support of finding the little girl, and in particular in Mazara del Vallo a meeting was organized this morning at 11:15 at the Palazzo dei Carmelitani, attended by various local and provincial authorities and the mother of the child, who has never stopped believing in a positive outcome to the case: "This is not a day of remembrance," comments Piera Maggio, "instead, it is a day of hope and we hope it will also be a day of justice," referring to the new developments introduced in the legal system in recent days. With the approval of the bill on public safety, the "Denise amendment" has finally been made law. Piera Maggio, following the disappearance of her daughter, had been requesting for years the inclusion of the crime of kidnapping a minor without the purpose of extortion in the penal code, and now, with the intervention of Minister Alfano, the legislative gap has been filled. Anyone who kidnaps a child under 14 now risks up to 15 years in prison and life imprisonment in the event of the child's death. Article 574-bis has also been introduced, which provides for a sentence of up to 4 years in prison for those who remove a minor from parental authority and keep them abroad. Hon. Barbara Mannucci, who promoted this legal innovation, comments: "All this will at least serve to punish more severely those who steal the identities of minors." Also in support of children throughout Italy, the Rome Agreement is being presented to the public, that is, the Italian signing of an international document on ethical journalism already approved in Switzerland, promoted by the "Children and media" committee, in which, among the various signatories, the Province of Trapani has taken the lead towards the U.P.I. This date, September 1st, is an important occasion. First of all, I want to emphasize what this day is not: it is not a day of memory and remembrance. This is the fifth year that my little girl has been away from home, and I really don't think it's appropriate to commemorate the date she was kidnapped. Instead, this is a day of hope. It is a day of tenacity and commitment, the day that sees us fighting to bring my daughter home.
